A school district in metro Atlanta is suing the state over funding for a charter school.

The Gwinnett County school district filed the lawsuit yesterday morning calling the newly formed Georgia Charter Schools Commission unconstitutional and alleges the panel wrongly forced the district to fund the Ivy Preparatory Academy in Norcross. The school district had previously denied the all-girls charter school funding because it was specially approved by the Georgia Board of Education rather than Gwinnett officials.

A new law allows the commission to require local districts to fund schools without local approval.

State education officials declined comment because they have not seen the lawsuit.
