Execution Of Man Who Killed Sheriff’s Deputy Going Forward

A 66-year-old death row inmate is scheduled to be executed Tuesday evening.
In a 6–to–1 decision, the Supreme Court of Georgia denied a stay of execution for Andrew Howard Brannan.
He is to be put to death tonight by lethal injection at the Georgia Diagnostic and Classification Prison in Jackson, Ga.
He was convicted in the January 1998 slaying of 22-year-old Laurens County sheriff's deputy Kyle Dinkheller.
Authorities have said Dinkheller stopped Brannan for driving 98 mph and demanded he take his hands from his pockets. Brannan then began cursing, dancing in the street and saying "shoot me" before he rushed the deputy and shot him nine times when he called for backup.
Lawyers for the Vietnam veteran said the shooting was tied to mental illness that can be traced directly to his military service. They argued executing Brannan was unconstitutional and that his life should be spared.
Tuesday the State Board of Pardons and Paroles denied clemency.
